Agreement to Terms
By accessing or using any PKAILabs service — including our website (pkailabs.io), WhatsApp Business AI assistant, web chat platform, or any API — you agree to be bound by these Terms of Service. If you do not agree, do not use our services.
These terms apply to both business clients (companies that purchase our services) and end users (customers who interact with a business's AI assistant powered by PKAILabs).
Description of Services
PKAILabs provides:
- WhatsApp Business AI Assistant: An AI-powered automated messaging service connected to a business's WhatsApp number via the official Meta WhatsApp Business Cloud API. The assistant answers questions from the business's approved knowledge base and escalates to human staff when needed.
- Web Chat Platform: An embeddable AI chat widget for business websites.
- AI Consulting & Integration: Custom AI workflow automation and integration services.
Acceptable Use
You agree to use our services only for lawful business purposes. You must not:
- Use the service to send spam, unsolicited messages, or bulk marketing without recipient consent.
- Use the service to harass, threaten, or deceive any person.
- Attempt to reverse-engineer, copy, or resell our AI systems or software.
- Provide false or misleading information during onboarding or in your knowledge base that could harm end users.
- Use the service in violation of Meta's WhatsApp Business Policy or any applicable law of Pakistan, or the jurisdiction in which your business operates.
PKAILabs reserves the right to suspend or terminate accounts that violate these terms immediately and without refund.
Payments & Billing
Setup fee: A one-time setup fee is charged before go-live. This covers onboarding, knowledge base configuration, and WhatsApp number registration. Setup fees are non-refundable once the go-live process has begun.
Monthly fee: Ongoing service is billed monthly in advance. Accepted payment methods include bank transfer (Pakistan), Easypaisa, JazzCash, and international card payment via Stripe.
WhatsApp conversation charges: Meta charges per conversation for business-initiated messages. These charges are passed through to the client at cost and itemised on your monthly invoice.
Late payment: Invoices unpaid after 14 days may result in service suspension. Service is restored within 24 hours of payment confirmation.
Refunds: Monthly subscription fees are refundable on a pro-rata basis if the service is cancelled within the first 7 days of a billing period. No refunds are issued after 7 days.
Pilot Programme Terms
PKAILabs offers a 30-day pilot package at a discounted setup fee. The pilot converts to a monthly subscription at the full rate if agreed success metrics are met. If metrics are not met, the client may discontinue without further obligation. The discounted setup fee is not refundable regardless of outcome.
Data & Confidentiality
PKAILabs treats all client knowledge base content, business data, and customer conversation data as confidential. We do not share, sell, or use client data for any purpose other than delivering the contracted service.
Clients are responsible for ensuring that the content they provide for their knowledge base (FAQs, price lists, documents) does not infringe third-party intellectual property rights.

Service Level & Uptime
PKAILabs targets 99% monthly uptime for the AI assistant service. Planned maintenance windows will be communicated at least 24 hours in advance via email or WhatsApp.
We are not liable for outages caused by Meta/WhatsApp platform downtime, third-party infrastructure failures, or events outside our reasonable control (force majeure).
Limitation of Liability
PKAILabs provides AI-generated responses based on information supplied by the business client. We are not responsible for:
- Inaccurate responses caused by incomplete or incorrect knowledge base content supplied by the client.
- Business decisions made by end users based on AI responses.
- Loss of revenue, data, or goodwill arising from service interruptions.
Our total liability to any client shall not exceed the total fees paid by that client in the three months preceding the claim.
Termination
Either party may terminate the service agreement with 30 days' written notice (email is sufficient). PKAILabs may terminate immediately for material breach of these terms, non-payment exceeding 30 days, or use of the service for unlawful purposes.
Upon termination, PKAILabs will provide a data export of the client's knowledge base and conversation logs (last 90 days) within 14 days, then delete all client data.
Governing Law
These terms are governed by the laws of the Islamic Republic of Pakistan. Any disputes shall be subject to the exclusive jurisdiction of the courts of Lahore, Punjab, Pakistan.
Changes to These Terms
We may update these terms from time to time. Clients will be notified by email at least 14 days before material changes take effect. Continued use of the service after the effective date constitutes acceptance.
